Dating a former client
'Til Death Do Us Part: Does a Client Ever Stop Being a Client?
Login name. Remember me. Minimum search word length is 3 characters - maximum search word length is 84 characters. My divorce attorney was female, so I guess that does not count as I date men? Interesting question, though. In my field, I would ask, should nurses date doctors? Generally no, for seceral reasons. Some ethical and some well the reputation of the whole thig is rather shakey. But another nurse, most definately, only if in another field line of work than myself.
Is this what we are asking? Or am I avoiding the question? That is alot for any lay person. More clarification EX-clients then? Sew, lol To correct, I suppose dating a client would be against the Code of Ethics? I have been told by another attorney it was unethical to date clients. Is it? I mean, your case is eventually over and both are free to pursue a relationship, right?
If the case is over, I see no ethics involved here. And even if it is not? IMHO, the same. Dating is just that, dating. It could be as simple as a cup of coffee I'm a lawyer in the UK and ethically it is not acceptable to date clients while representing them. However, once you are no longer in professional relatrionship, I see no problem. I suppose the difficulty is that I deal in family law and I see people at their lowest point, very vulnerable etc.
It is seen as playing on that vulnerability that is the problem. I think it's much the same here. Not against the rules, per se. But can oppen the attorney to civil suits if done while on the case, so to speak. But I believe they have guidelines, like 6 months to a year after, something like that. But while most may consider it unethical, it's not illegal, as far as I know. It's like a surgeon operating on family. Some do it, some don't. I don't see any problems myself, except where there could be conflict of interest or the interests of the client would be compromised, like in a divorce case.
I'm not sure what the name of the ethical codes lawyers in the US subscribe to, you may want to do a little bit of research on that topic. Anyway, I am a professional clinical counselor and it would be an ethical violation for anyone in my field to have inappropriate contact dating, unsupervised meetings outside of the office with a client. After termination of the counseling relationship, we can not have intimate contact with a former client before 2 years has passed.
There is also a power differential here, as Willit mentioned, attorney in a more powerful position and client dependent, needing help. This does make you more vulnerable to being "played on", so please be careful here, omw. You have been thru enough, I'd hate to see you taken advantage of here. CM, an interesting concept you answered about being needy or in a vulnerable position Another thought Are fees "waived" or discounted once the dating starts?
Was this discussed openly, implied? This potentially could be construed as being "coerced", or worse Just something else to consider. It is not fair to use anyone to get what one wants. I have a friend who is an attorney in MT. A woman he dated, was in trial with another attorney, obviously a colleague. A very nasty, long divorce case where the ex-husband accused her of everything possible. However she decided to date my attorney friend. A very small town, most knew everyone, and everyone's personal business.
The end result was that my friend was used as a person of influence during her divorce case. Her only motivation for dating him was for a positive influence and hopeful outcome for her own divorce case. My friend, who ended up hurt in the process never saw it coming. He thought he was in love with her, and of course on her behalf sought to influence the outcome of her case with his colleague Needless to say, she worked him, she dumped him when the case was over, and left him very hurt.
She used him. Took him awhile to get over it, as it also affected his reputation. Sounds terrible doesn't it? Point being, and did not mean to utilize an "attorney" story, but is the subject matter to an extent but in many relationships, there are not too many people that can be trusted these days, and as the themes are so played out in these threads, many people have been used and hurt.
